Personal eCash Banking Agreement and Disclosure Statement

The following information represents the "Personal eCash Banking Agreement and Disclosure Statement" (Agreement) between you and Rockford Bank and Trust Company (RBT). Please read this entire document prior to using this service and retain a copy for your records.

This Agreement is made between you and RBT for accessing your RBT Accounts using our web site (www.rkfdbank.com). As used in this document, the words, "we", "our", and "us" mean Rockford Bank and Trust Company and assigns the words "you" and "your" to mean each Account holder(s) and anyone else with the authority to deposit, withdraw, or exercise control over the funds in the Account(s). Personal eCash Banking Services (Services) means the communications and transactions provided to you by us through Personal eCash Banking or Bill Pay, including but not limited to the following: Account information, funds transfers, bill payments, stop payments, statement/transaction inquiries and downloads.

By using the Services, you agree to abide by the terms and conditions of this Agreement and acknowledge your receipt and understanding of the disclosures contained in this Agreement. This Agreement is in addition to other agreements between you and us, including the applicable deposit Account disclosure agreement(s) and terms and conditions, and our rules and regulations, as well as applicable credit card and other loan agreements with us. If there is a conflict between the terms and conditions of this Agreement and the terms and conditions of any other agreements between you and us, this Agreement will govern.

When you use our Services, you agree to the terms and conditions we have set forth in this Agreement and any instructional material, which we provide regarding the Services. Your use of the Services may be made possible by use of certain numbers, codes, marks, signs, public or private keys or other means of establishing your identity and acceptance of the electronic communications, which are acceptable to RBT. All electronic communications that meet these requirements will be deemed to be valid and authentic and you intend and agree that those electronic communications will be given the same legal effect as written and signed paper communications. You agree that electronic copies of communications are valid and you will not contest the validity of the originals or copies, absent proof of altered data or tampering.

We may, from time to time, introduce new Services. We will notify you of the existence of these Services. By using the new Services when they become available, you agree to be bound by the rules governing these new Services, which will be communicated to you.

  1. Equipment

    To access the Services, you must have an active account with an Internet Service Provider (ISP), the Internet browser software program Internet Explorer which provides 128-bit encryption and any necessary hardware and other software (collectively, "Equipment"), and an IBM-compatible PC with at least a Pentium Processor. Other browsers and operating systems may also work, however, due to compatibility reasons using Internet Explorer and an IBM-compatible PC with at least a Pentium Processor are recommended. If you use another browser, you must ensure the browser provides 128-bit encryption. From time to time, we may recommend browser upgrades to maintain the latest encryption technology.

    You are responsible for, at your expense, obtaining, installing, maintaining and operating all necessary hardware, software and communication devices that access the Services. You must be an authorized user of the Equipment you use. We do not warrant nor will we be responsible for any errors or failures from the malfunction or failure of your Equipment.
     
  2. Account Access

    To access your Account(s) through the Services, you must have at least one Eligible Account with us. For purposes of this Agreement the term "Eligible Account" includes the types of deposit and credit Accounts that are identified below. If you have more than one Account or other relationships with us, we will "link" the relationships together unless you request certain Accounts not be linked. Accounts, which are “linked” under the Services, will have one common Social Security Number. Any signer, acting alone, must be authorized to access a linked Account. Any non-linked Account will not be accessible through the Service. An Account that requires two or more signatures to make withdrawals may not be designated as an Eligible Account.

    Eligible Accounts that you may request access to through the Services include:
     
    • Checking: Basic*, Convenient*, Senior*, Premier*, Premier Plus*
       
    • Savings: Steady Savings, Money Market, Future Fund, Senior Plus, Student Fund
       
    • Certificates of Deposit
       
    • Installment Loans
       
    • Line of Credit (Restricted access: You can only view balance and make payments)
      (* Accounts eligible for Bill Pay Services)
       
  3. Access Codes
     
    During your use of the Services, you are required to enter:
     
    1. User Name (A User Name will be assigned to you upon the opening of your Services. You will receive this with your Welcome Kit.)
       
    2. Pre-assigned Password (To maintain your privacy and protect your financial information, a pre-assigned password will be sent to you in a second mailing. After accessing the system, you are encouraged to change your password. Choose a password that is a least 5 characters. While you can choose to use all numbers or all letters, a combination of both is recommended. Avoid using an easily guessed password such as your name, your significant other’s name, your pet’s name, or your birthday.)
      For the purpose of this Agreement the term "Access Codes" includes the User Name and Pre-assigned Password. Use of these Access Codes is the agreed security procedure to access the Services. You agree to keep these Access Codes confidential to prevent unauthorized access to your Accounts and to prevent unauthorized use of the Services. For security purposes, we recommend that you change your pre-assigned password after logging in to the system and then, for added security, at regular intervals thereafter. Anyone you give your Access Codes to can view your Accounts, make transfers, and conduct bill payments.
       
  4. Available Services
     
    1. Account Information

      You may obtain account balance, summary information, transaction information, interest information, loan payment amounts, payment due dates and certificate of deposit maturity dates.
       
    2. Funds Transfers

      You may transfer funds between your various Accounts, and make loan payments from your Accounts. You may make "One Time Transfers" or you may set up "Recurring Transfers" on these Accounts. You may make transfers occur at the earliest possible time, a future date, or on a recurring basis.

      If a hold has been placed on deposits made to an Account from which you wish to transfer funds, you cannot transfer the portion of the funds held until the hold expires. You agree that you will instruct us to make a transfer only when a sufficient balance is or will be available in the designated Account at the time of the transfer. You understand that we will not act on any transfer from you if sufficient funds are not available in the Account that you designated.

      Your ability to make transfers from your Accounts are restricted by Federal Reserve Board Regulation D. For each of following accounts: Steady Savings, Money Market, Senior Plus, Student Fund you are prohibited from making more than six pre-authorized transfers per month, no more than three of which may be payable to third parties, such as checks, ACH transfers or debit card entries. Pre-authorized transfers include transfers made through the Services. (For additional information on the limitation, please refer to the Deposit Account Terms and Conditions Brochure you received when opening your Account(s).) Once an account has violated the Regulation D limit rules, RBT will automatically convert the account to a "Transaction Type Account". A Transaction Type Account is an account that does not have limitations on the number of withdrawals or transfers, and will have different interest rates then a money market or savings account. The parameters of the Future Fund Saving account allow only one withdrawal to be made on a specific date of your choosing, which is determined at the time this account is opened. As such, fund transfers cannot be made from this account. The RBT Line of Credit (LOC) is also a restricted account, which allows you to only view balance information and make payments. Therefore, transfers cannot be made from the LOC.
       
    3. Account Services
      You may obtain other Service(s) related to your Eligible RBT Account(s). Specifically, you may utilize Bill Pay for a fee.

  5. E-mail

    Non-encrypted e-mail is not a secure method of communication over the Internet and we strongly recommend you do not send confidential information by e-mail.

    You agree that we may send you or make available to you notices, disclosures and other information electronically, including (but not limited to) notices, disclosures and other information required under the Electronic Funds Transfer Act and Regulation E of the Federal Reserve Board. We may send this information to you by posting it on our web site or by e-mail. This information is not confidential and is sent by regular unsecured e-mail. We may also send it to you by regular postal mail in writing, at the address shown in our records. If you have given us an e-mail address or postal address, we are entitled to rely on that address and assume that messages sent to that address are received by you, until you give us notice in writing that the address is no longer valid. You agree that information we post to our web site or send by e-mail or regular postal mail will be deemed delivered at the time it is posted or sent. Information you send to us is deemed delivered when we receive and review it.   6. Bill Payment
    This is your Bill Pay agreement with RBT. For a fee, you may use Bill Pay to direct us to make payments from your designated checking account to the Payees you choose in accordance with this agreement. "You" or "your" means each person who is authorized to use the service. "Payee" means anyone, including RBT, you designate and RBT accepts as a payee.

    How to Set up Payees/Payments

    Complete a Bill Pay enrollment form. You may add a new fixed payment to a Payee, only if the Payee is on your authorized list of payees, and by accessing the Service and entering the appropriate information. Most other additions, deletions, or changes can be made in writing or by using the Service. RBT reserves the right to refuse the designation of a Payee for any reason. Each Payee accepted by RBT will be assigned a Payee code. A “Payee” is defined as anybody (company or individual) to whom you want to send money. You may pay almost any Payee you wish. There are several restrictions: 1) The Payee must be located in the United States; 2) Payments may not be remitted to tax authorities or government and collection agencies; 3) Payments may not be remitted to security companies such as Ameritrade for stock purchases or trade taxing authorities and 4) Court directed payments are unauthorized (Alimony, child support, or other legal debts).

    RBT is not responsible if a bill payment can not be made due to incomplete, incorrect, or outdated information provided by you regarding a Payee or if you attempt to pay a Payee that is not on your Authorized Payee list.

    Accessing the Service

    Only those individuals using the Services will have access to Bill Pay. When you successfully log into the Services, you will be able to access Bill Pay by selecting that button. If you are not a registered Bill Pay user, you will be presented with an enrollment form.

    Requesting Additional Assistance

    If you have any questions regarding Bill Pay, customer support is available by calling 1-866-484-3936. Simply press “5” and a service representative will assist you. Service representatives are standing by Monday through Friday from 6:30 a.m. to 10:00 p.m. Central Standard Time (CST). Additional support options are also available online through the Bill Pay system.

    The Bill Paying Process

    RBT will process variable payments on the business day (generally Monday through Friday, except holidays) you designate the bill is to be processed, provided the payment request is received prior to the cut-off time set by RBT, which is currently 2:00 p.m. CST. Variable bill payment requests received after the business day cut off time, or at any time on a non-business day will be processed on the next business day. RBT reserves its right to change the cut-off time by giving you notice if it changes.

    FOR RECURRING PAYMENT REQUESTS, IF YOU DESIGNATE A PROCESSING DATE OF THE 28TH THROUGH THE 31ST OF A MONTH, PROCESSING WILL BE INITIATED ON THE LAST CALENDAR DAY OF THE MONTH. Otherwise, recurring payment requests will be processed on the dates you have designated, unless such date falls on a non-business day resulting in your payment being processed on the next business day.

    YOU MUST ALLOW AT LEAST FIVE (5) BUSINESS DAYS, PRIOR TO THE DUE DATE, FOR EACH BILL PAYMENT (RECURRING OR VARIABLE) TO REACH THE PAYEE. IT IS YOUR RESPONSIBILITY TO SCHEDULE/ACTIVATE RECURRING PAYMENTS. IT IS OUR RECOMMENDATION THAT ADDITIONAL DAYS BE ALLOWED FOR PAYMENTS TRAVELING MORE THAN 4 STATES AWAY.

    You agree to have available and collected funds on deposit in the Account you designate in amounts sufficient to pay for all bill payments requested, as well as any other payment obligations you have to RBT. RBT reserves the right, without liability, to reject or reverse a bill payment if you fail to comply with this requirement or any other terms of this agreement. If you do not have sufficient funds in the Account and RBT has not exercised its right to reverse or reject a bill payment, you agree to reimburse RBT for such payment obligations on demand. You further agree RBT, at its option, may charge any of your Accounts with RBT to cover such payment obligations.

    Any bill payment can be changed or canceled, provided you access the Service prior to the cut-off time on the business day prior to the business day the bill payment is going to be initiated.

    Liability

    You will be responsible for any bill payment request you make that contains an error or is a duplicate of another bill payment. RBT is not responsible for a bill payment that is not made if you did not properly follow the instructions for making a bill payment. RBT is not liable for any failure to make a bill payment if you fail to promptly notify RBT after you learn that you have not received credit from a Payee for a bill payment. RBT is not responsible for your acts or omissions or those of any other person, including, without limitation, any transmission or communications facility, and no such party shall be deemed to be RBT’s agent. In any event, RBT will not be liable for any special, consequential, incidental, or punitive losses, damages, or expenses in connection with this agreement or the Service, even if RBT has knowledge of the possibility of them. RBT is not liable for any act, failure to act or delay in acting if it is caused, in whole or in part, by any cause beyond RBT’s reasonable control.

    Amendment and Termination

    RBT has the right to change this Bill Pay agreement at any time, unless it affects an aspect of the agreement where additional notice is required by law. Notice may be provided by mail to the last address shown for your Account on the RBT’s records, or by posting notice in branches of RBT, or as otherwise permitted by law.

    RBT has the right to terminate this Bill Pay agreement at any time. You may terminate this Bill Pay agreement by written notice to RBT. RBT is not responsible for any payment made before RBT has a reasonable opportunity to act on your termination notice. You remain obligated for any payments made by RBT on your behalf.

    Fees

    The fee for Bill Pay is $4.95 per month, for an unlimited number of monthly payments.

    The charges listed below will only be assessed if you request one or more of the services listed here. There will be NO Charge for any item if needed to correct a RBT error.

    Per proof of Payment not necessitated by a dispute ... $10.00
    Payments returned due to customer error ... $5.00
    Overdraft fee ... $25.00 or a daily maximum fee of $250.00
    Return fee ... $22.00 or daily maximum fee of $220.00

    RBT reserves the right to charge you for research time involving payments no longer available in your screen history. You will be informed of any such charges before they are incurred.

    Bill payments are processed by Electronic Fund Transfers (EFT). Please see the Electronic Fund Transfers Disclosure Statement included, or, received when you opened your Account, which discloses important information concerning your rights and obligations.

    Service Charges or Fees

    RBT’s Bill Pay users will be charged the applicable Monthly Fee and/or Service Charges whether or not you use the Service. You authorize us to automatically deduct all applicable charges and fees from your primary checking Account you have with us. Your Accounts are subject to any fees normally assessed with your Accounts.   7. Business Days and Hours of Operation

    For the purpose of this agreement, our hours of operation are Monday through Friday, excluding federal holidays, from 8:00 a.m. to 5:00 p.m.
    You can access the Services seven days a week, 24 hours a day. However, at certain times, some or all of the Services may not be available due to system maintenance. We also may need to change our available Services from time to time. We will attempt to provide prior notice of such interruptions and changes but cannot guarantee that such notice will be provided.

    A transfer between deposit accounts initiated through the Services until 5:30 p.m. CST on a business day is posted to your account the same day. A transfer between deposit accounts initiated after 5:30 p.m. CST on a business day, or initiated on a Saturday, Sunday, or federal holiday, will be posted on the next business day. Bill Pay transactions can be submitted on any day but will only be processed on Business Days.
     
  8. Reporting Unauthorized Transactions

    If you believe that an unauthorized transaction has been or may be conducted through the Services without your permission, immediately contact us at (815) 961-9383 or write us at: Rockford Bank and Trust, Online Banking Customer Service, PO Box 1748, Rockford, IL 61101-0248. All terms and conditions regarding unauthorized transactions as listed in the Deposit Account Terms and Conditions Brochure, Electronic Fund Transfers Disclosure, are applicable.
     
  9. Our Responsibility

    We, or a third party acting as our agent, are responsible for completing fund transfers on time according to your properly entered and transmitted instruction. However, neither we nor the Service Provider will be liable if:
    1. If you do not have adequate money in an Account to complete a transaction from the Account, or if that Account has been closed.
       
    2. If you have not properly followed Software or service instructions on how to make a transfer.
       
    3. If you have not given complete, correct and current instructions so that a transfer can be made.
       
    4. If withdrawals from any eligible Accounts have been prohibited by a court order such as a garnishment or other legal process.
       
    5. If we or our agent reasonably believe that a transaction may be unauthorized and based thereon the transaction is not completed.
       
    6. If your Equipment and/or Software were not working properly.
       
    7. If you conduct a transaction that would violate Federal Reserve Regulations or any other law.
       
    8. If circumstances beyond our, or our agent's, control prevent making a transfer or payment, despite reasonable precaution that we have taken. Such circumstances include but are not limited to computer failure, telecommunication outages, terrorism, postal strikes and other labor unrest, delays caused by fires, floods, and other natural disasters.

      There may be other exceptions to our liability as stated in your Deposit Account Terms and Conditions Brochure, Electronic Fund Transfers Disclosure.
       
  10. Liability for Loss or Erroneous Data

    Except as otherwise provided in this Agreement or otherwise expressly provided by applicable law or regulation, you agree that neither we nor any party provides Internet access or provides Equipment used to access the Services, nor any agent, independent contractor, or subcontractor of any of the foregoing (“Service Providers”) will be liable for any loss, injury, or damage, including, without limitation, direct, indirect, incidental, special, consequential or punitive damages, whether under a contract, tort or any other theory of liability, arising in any way out of the installation, use or maintenance of the Services, or of the Internet access provider used to access the Services, or of the Equipment used to access the Services, including, without limitation any loss, injury or damage relating to any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus, line failure or unauthorized interception or access to your communications with us, even if we or the Service Providers are aware of the possibility of such events.
     
  11. Privacy

    You agree we may release, or assist in the release of credit and other Account information to a third party as may be necessary to process a transaction or resolve disputes.
     
  12. Security

    In order to maintain secure communications and reduce fraud, you agree to protect the security of your numbers, codes, marks, signs, public keys or other means of identification. We reserve the right but are not obligated to block access to the Services to maintain or restore security to our Site and systems; if we reasonably believe your Access Codes have been or may be obtained or are being used or may be used by an unauthorized person(s).
     
  13. Ownership of Materials

    The content and information on our site is the property of RBT, Bettendorf, Iowa. It should not be duplicated, or copied, for purposes other than record retention.
     
  14. Severability

    If any provision of this Agreement is void or unenforceable in any jurisdiction, such ineffectiveness or unenforceability shall not affect the validity or enforceability of such provision in another jurisdiction, or any other provision in that or any other jurisdiction.
     
  15. Venue

    Any action at law, suit in equity, or other judicial proceeding for the enforcement of this Agreement or any provision thereof shall be instituted only in the Iowa District Court in and for Scott County. This Agreement shall be interpreted under the laws of the State of Iowa.
      
  16. No Signature Required

    When any payment or other online service generates electronic debits to be charged to your Account, you agree that we may electronically debit your designated Eligible Account or the Account on which the item is drawn without requiring your signature on the item, and without prior notice to you.
     
  17. Amendment of this Agreement

    We may amend this Agreement (including changes in its fees and charges hereunder) by giving notice to you at least 30 days before the effective date of the amendment, unless such change or amendment is otherwise required by law or applicable regulation. Your continued use of the Services is your agreement to the amendment(s).
     
  18. Termination

    You may terminate this Agreement and any service provided hereunder at any time upon giving at least 10 days prior written notice of termination to RBT. Once we have acted upon your termination notice, we will make no further transfers from your Eligible Accounts, including any fund transfers you have previously authorized. We reserve the right to terminate or to discontinue support of any software or equipment without written notice. RBT reserves the right to terminate your use of the Services at any time.
